On 25 November 2021, the European Commission (the “THIS“) published its proposal (the “EC proposal“) of a directive amending the directive on alternative investment fund managers (“AIFMD“). The EC proposal is a key element of the EC package on the Capital Markets Union together with the other proposals relating to: (i) the creation of a single European access point; (ii) changes to the ELTIF framework; and (iii) revision of the MiFIR rules Notwithstanding the general assessment that the AIFMD is “usually achieves goals“, the EC has identified a number of areas under AIFMD which it believes could be improved.
